The Anti-Kickback Statute (AKS) applies not only from the standpoint of merging health care organizations, but also for physicians contracting with health care organizations. The basic premise is that business relationships should be clean, without one party paying the other for business. Hospitals, pharmaceutical companies and insurance and device companies are evaluated by how they do business directly with physicians, since physicians refer patients to that organization.
